You have the right to withdraw from the contract, without giving reasons, within 14 days, only if you have purchased products that do not require any customization (example: bracelets without any engraving), as required by art. 59, letter c) of the Consumer Code. Otherwise, if you have just purchased a personalized product and want to exercise the right of withdrawal, you can do so if this occurs within 24 hours of order confirmation and only if the product has not yet been shipped. Shipment is confirmed once the courier collects the package containing the personalized product and the customer is notified by e-mail of the shipment. Therefore, if the reconsideration takes place within 24 hours of the order but with the ordered goods already on the way, then it will not be possible to make a refund.
In the case of non-personalized products, therefore, the withdrawal period expires after 14 days from the day:
a) in the case of a service contract, the conclusion of the contract;
b) in the case of a sales contract, in which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods;
c) in the case of a contract relating to multiple goods ordered by the consumer in a single order and delivered separately, in which you or a third party, other than the carrier and designated by you, acquires physical possession of the last good;
d) in the case of a contract relating to the delivery of goods consisting of multiple lots or pieces, in which you or a third party, other than the carrier and designated by you, acquires physical possession of the last lot or piece.
To exercise the right of withdrawal, you must inform us by email at info@pendi.it or by registered mail at via mill meadows 5D, Botticino (BS), 25082, of your decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post, fax or e-mail). To this end, you can use any withdrawal form available online.
The refund may be suspended until receipt of the goods or until the consumer demonstrates that he has returned the goods, whichever comes first.
You are requested to return the goods or deliver them to us or to via Molino Prati 5D, Botticino (BS), 25082 , without undue delay and in any case within 14 days from the day on which you communicated your withdrawal from this contract to us. The deadline is met if you send back the goods before the 14-day period has expired.
The direct costs of returning the goods will be at your expense.
You are only liable for any diminished value of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
